Our affiliate terms and conditions

§ 1 Subject matter of the contract
1. the subject of this contract is the participation in the partner programme of Metalldetektoren.de - Andreas Licht hereinafter referred to as Affiliator. The partner programme enables the placement of electronic advertising media, e.g. banners on an online advertising medium of the partner.
2. the partner receives a commission of 10% for each successfully generated and paid order. For exceptions, see § 6.
3. the following conditions apply to participation in the partner programme

§ 2 Advertising media and online advertising media
1. an advertising medium enables a link between the partner's online advertising medium and the affiliate by means of an HTML hyperlink, via which visitors to the partner site can reach the affiliate.
2. the formats and design of the advertising media are defined solely by the affiliate. The integration into the online advertising medium is the responsibility of the partner.
3. the partner's online advertising medium is a website/newsletter

§ 3 Application for participation in the Affiliator partner programme and admission of partners
1. partners apply by submitting a complete application online via the affiliate programme on the Affiliator homepage
2. the Affiliator reserves the right to reject registrations if the content of the partner website does not correspond to the Affiliator's objectives.
3. the contract comes into force as soon as the Affiliator has approved the Partner's application and informed the Partner of this by e-mail.
4. the applicant affirms that he/she is at least 18 years old, has full legal capacity and has a bank account in the European Union.
5. if the partner operates several websites (domains) and wishes to participate in the partner programme with these, the partner is obliged to register individually for each website.

§ 4 Obligations of the Partner
1. the partner is responsible for the operation and maintenance of his website as well as for all content and up-to-dateness. The Partner guarantees that it will not provide any content that is contrary to common decency and applicable laws. This includes, in particular, depictions of violence, sexually suggestive images and discriminatory, offensive or defamatory statements regarding race, gender, religion, nationality, disability, sexual orientation or age.
2. the Partner warrants that the content of its website does not infringe any third-party rights. This applies in particular to patent, copyright, trade mark and other industrial property rights.
3. the partner is responsible for the proper integration of the affiliate advertising material. The HTML source code provided by the Affiliator may not be changed by the Partner in order to ensure smooth billing.
4. the Affiliate undertakes to indemnify the Affiliator against any claims by third parties arising from the operation of its website and the costs of their defence. In addition, the Partner is obliged to support the Affiliator in the defence against such claims by providing explanations and information.
5. the Partner is prohibited from setting up a website that could cause confusion with the Affiliate's website. The Partner may only use advertising material on its website that has been made available to it by the Affiliate via the Affiliate Programme.
6. furthermore, the partner is prohibited from using search terms in search engines that are associated with the affiliate's brand name.
7. the partner undertakes to remove advertising material from his website immediately if he is informed of this by the affiliate.
8. the Partner is prohibited from passing on commissions or discounts paid to him by the Affiliator via the Affiliate Programme - in whole or in part - to third parties/end customers without written agreement with the Affiliator.
9. breaches of these obligations will result in immediate exclusion from the Affiliator Partner Programme.
10. with reference to the general terms and conditions of the networks, we point out that the sending of e-mails/newsletters to interested parties may only take place if they have expressly agreed to this in advance.

§ 5 Services provided by the Affiliator
1. in the protected area of the partner programme, the partners have access to the HTML source texts of the existing advertising material, which they integrate into their websites.
2. the affiliate programme logs the performance achieved via the advertising media and regularly provides the affiliate with up-to-date statistics on all its performance in the protected area. The affiliate is responsible for payment of the advertising cost reimbursements generated.
3. the Affiliator is responsible for the entire processing of the brokered order and reserves the right to reject orders that do not comply with Affiliator guidelines (e.g. negative credit checks, address checks).
4. a legal relationship is established between the customers referred by the Partner and the Affiliator, to which the Affiliator's General Terms and Conditions apply exclusively.

§ 6 Commissions
1) Entitlement to a commission arises when the Partner has brokered a successful business transaction. A successful business transaction occurs when an online buyer has placed an order with the Affiliator and this is delivered. The affiliate receives a standard commission of 7.5 %. Affiliates are informed by e-mail about special promotions defined by the Affiliator or can view them at www.domain des Affiliator/partnerprogramm.
An order is deemed to have been successfully placed if the following conditions are met:
There has been a successful business transaction based on the advertising space provided by the partners in the affiliate's shop.
The transaction has been successfully recorded by the affiliate's shop.
The end customer accepts delivery of the goods at the shipping destination, makes payment in full and the cancellation period of 14 days has expired.
The order or order value does not include: zero value orders (catalogue requests) or vouchers. Furthermore: The shipping costs paid by the customer, the VAT shown and all optional service fees such as surcharges for 24-hour delivery, extended warranty, etc: All successful orders resulting from a visitor to an affiliate site ordering products directly from the affiliate's www.domain via affiliate advertising material are taken into account, as well as all orders placed by this visitor within 30 days of their first visit to the affiliate's domain, provided that their browser settings accept cookies, they can be identified by the affiliate's shop via this cookie and the cookie is not overwritten by that of another affiliate cooperation partner within this period.
- The affiliate receives a commission for each successful order
There is no entitlement to reimbursement of expenses and costs in connection with the affiliate's advertising activities. - All successful orders are credited to the partner and settled on the last day of the month. Payment will be made by bank transfer to the bank account specified by the partner, provided that the minimum payment amount of 25 euros per month has been reached and the partner confirms and authorises the payment amount. The confirmation and release must be made by the 10th of each month.
If the payout amount of 25 euros is not reached at the end of a month, the credit will be carried over to the following month. Litho-Verlag e.K. reserves the right to withhold rewards below this limit until the minimum amount is exceeded in a subsequent month. No interest will be paid on unpaid premiums. Withheld rewards will be paid out after termination of the contractual relationship if they exceed the payout amount of 25 euros.
If a partner is subject to VAT within the meaning of European law, the partner undertakes to inform the affiliate of his VAT ID number when registering. Payment of the advertising cost reimbursement is made plus VAT. The Affiliate is solely responsible for the proper taxation of income and the payment of social security contributions. The Affiliator will claim reimbursement from the Partner for any subsequent claims by a public authority resulting from incorrect information provided by the Partner.

§ 7 Licences
1. the Affiliator partners receive a non-exclusive, non-transferable and revocable right to use the advertising material mentioned in §2, but only within the framework of this partner contract and the agreements set out therein. The licensed advertising material may not be changed by the Affiliate.
2. the Affiliator grants himself the right to withdraw the licence granted at any time by written notification by e-mail without giving reasons. The licence agreements end with the termination of this contract.

§ 8 Independence of the contractual partners
1. the Affiliator and the Partner are independent parties and operate their websites independently of each other. This contract does not establish a joint company or community, nor does it establish an employment relationship or a commercial agency agreement. Neither the Partner nor the Affiliator is authorised to act on behalf of the other Partner and/or to make statements on the other Partner's behalf.

§ 9 Term of contract and cancellation
1. this agreement is concluded for an indefinite period and may be terminated by either the Affiliator or the Partner at any time by e-mail without notice.
2. after termination of this agreement, the Partner is obliged to remove all advertising material and links to the Affiliator's shop page from its website.
3. the Partner is only entitled to a commission during the term of the agreement.

§ 10 Amendment of this agreement
1. the Affiliator has the right to amend this Agreement at any time. The partners will be informed of this by e-mail.
2. the Partner may object to the amendment within 30 days. If no objection is received by the Affiliator within this period, the changes are deemed to have been accepted by the Partner and become part of the contract.
3. this does not affect the Partner's right to terminate the contract with due notice due to the amendment.
